State judge’s order to strike down new elections rules will remain in place

The Georgia Supreme Court has unanimously denied taking up an appeal to reinstate election rule changes that were recently struck down by a Fulton County Superior Court Judge.

The state election board voted in September to implement a number of new rules.

One rule would have required ballots, not votes, at each precinct to be hand-counted by three separate county officials.

There was also a provision directing county boards to certify election results only after “a reasonable inquiry.”

Floyd County Attorney Virginia Harman commented on the ruling during Tuesday’s Floyd County Commission meeting.

“Our board of elections was prepared whichever way that decision went, either to comply with those rules or go forward with the rules as they existed,” she said. “The Fulton county order that will remain in place is an order to comply with the rules as they existed prior to the SEB’s actions.”

Early voting for the November 5 General Election continues until November 1.
