The Floyd County Commission has approved a special use permit for an RV park on Davis Road in Cave Spring.
The application first came to the commission in April, but the board opted to allow the developer Anthony Carver to adjust the plans.
Carver told the commission Tuesday that they have widened the road on the concept plan, have addressed an easement issue with an adjoining property owner, and have done the proper amount of soil testing for the septic system.
“I want you to ask yourself if there is any other legal matter or state regulation that would keep us from doing this,” Carver told the commission. “We believe the answer is no. It can be done with proper engineering, following all the rules and guidelines for the state and county. We have all the correct buffers and setbacks on our concept plan.
However, nearby residents continue to express concerns about issues such as crime and the potential for flooding.
Attorney Jeremy Salter spoke on behalf of nearby residents who opposed the RV park. He said there is no reason not to believe that the applicant is going to do what he says he is going to do. However, the concern is with what future owners of the property might do, and there needs to be some rules and regulations.
Commissioner Wright Bagby made the motion to approve with five conditions.
“RV spaces would be limited to no more than 50,” Bagby said. “The applicant shall upgrade the existing Davis Road from the entrance to the park site to the entrance to U.S. 411, and Davis Road to the local road cross-section according to the Unified Land Development Code, at the applicant’s expense. The applicant shall follow the tentative agreement with the Bagwells set forth in the application to address the relocation of the irrigation easement. The applicant shall surrender previously granted SUP for special events venue on the property.”
Failure to abide by all applicable state, federal, and local laws, rules, and regulations would result in a forfeiture of the special use permit.
